Andrew Waghorn: Dundee rapist who removed condom during sex without consent jailed for 'stealthing'

A man who removed a condom during sex without consent has been jailed for rape.
Andrew Waghorn, 31, is believed to be the second man in Scotland to be prosecuted for "stealthing" - where a condom is removed or not used without a partner's knowledge.
The case follows that of actor and self-proclaimed "Brad Pitt body double" Luke Ford, who was last month jailed for 16 years for a string of sex attacks that also included stealthing.
Waghorn denied any wrongdoing during a trial at the High Court in Dundee last year but was convicted of raping two women.
A Police Scotland detective branded Waghorn a "dangerous individual who has committed serious crimes".
Jurors heard how he raped his first victim in 2014 at a stately country hotel in Fife following a wedding reception.
The second victim was raped via stealthing at a hotel in Dundee following a night out in the city in 2020.
The court heard how Waghorn and the woman were having consensual sex before he removed the condom.
Waghorn was said to have seized the woman's hand and moved it away from her private parts before he started to have non-consensual sex.
Judge Lord Summers stated: "This rape was accompanied by a degree of force."
Following Waghorn's conviction, the court heard of a previous conviction for domestic abuse against his second victim for which he was handed a community payback order in 2022.
Between November 2018 and July 2020, Waghorn's bad behaviour included struggling with the woman and repeatedly taking hold of her phone to prevent her from contacting her mother.
He also restrained her while in possession of a knife, monitored her movements and instructed her not to speak to others.
His abuse included repeatedly phoning her, leaving voicemails and sending texts, repeatedly threatening her and repeatedly threatening to self-harm.
He would also loiter outside her workplace, her home, and the home of one of her friends.
Waghorn also repeatedly approached her and demanded she enter a vehicle with him, repeatedly tried to enter her vehicle while she was in it and punched the window.
He also followed her in a vehicle.

Passing sentence, Lord Summers made reference to letters of support which spoke of Waghorn's character.
However, the judge added: "I have to observe that the care and courtesy that you are apparently capable of was not extended to your two victims."
Waghorn, of Dundee, was jailed for six years and one month at the High Court in Edinburgh on Tuesday.
He was also placed on the sex offenders' register for life.
Following the court case, Detective Inspector Graeme Wishart said: "Andrew Waghorn is a dangerous individual who has committed serious crimes against his two victims, subjecting them to sexual abuse and violence.
"We acknowledge how difficult this has been for Waghorn's victims. We hope this conviction and sentencing will bring them some comfort and our thoughts remain with them."
